An ICA spokesman, David Acheson, said: "Legislation does not have the flexibility of a Code of Practice and is likely to impede the growth of franchising in Australia, which is creating over 100 new jobs a day." The Motor Traders' Association has long sought to develop franchising relations based on mutual trust and co-operation. The industry would be best served by full disclosure Upon entering negotiations to purchase a franchise, and by allowing franchisees a reasonable measure of sovereignty in their businesses. If the recommendations of the Gardini Review are implemented, the MTA believes a number of desirable results would be gained.
All reputable franchisors would join the code, including those in the retail motor industry who have so far failed to participate. There would also be greater disclosure of the terms of the conditions under which each franchisor and franchisee do business. The recommendations would ensure that proper standards of business conduct were adhered to within the franchising industry, with better resolution mechanisms for resolving disputes when they arise. The largest single category of franchised operators is the retail motor trades. A high portion of the retail motor industry's $60 billion annual turnover is through franchised outlets. Franchised businesses include new motor vehicle dealers, petrol resellers, auto repair firms and parts suppliers. The MTA has been a strong supporter of the Franchising Code of Practice, introduced in 1993 to provide an equitable framework for relationships and the resolution of disputes within the franchising industry. The code is voluntary and will, if successful, promote the continued growth and success of franchising in Australia and ensure fair treatment to all parties.
It is unfortunate that many franchisors, notably motor vehicle manufacturers and importers, yet have to agree to participate in the code. The code is administered by the Franchising Code Administration Council, whose directors are drawn from the ranks of franchisors, franchisees, service providers and a legal representative. The aim of the council is "to ensure that the Australian franchising sector adopts world-best franchising practice to ensure that all participants in franchising benefit." The results of a review of the franchising industry were Hill was delighted, and said he felt confident for the opening grand prix of the 1995 championship in Brazil on March 26. "Things have gone incredibly well. There have been no problems at all.
I am completely happy and I cannot wait for the season to Start," he said. Hill's chief rival, the German Schumacher, was having a troubled time with the Benetton team. Hakkinen's best time of 1:23.31, however, indicated that the team was still struggling to match the pace of the front-running Williams team. Mansell will get his first run in the revised McLaren on Wednesday. At Silverstone, the Arrows Formula One motor racing team yesterday unveiled its new grand prix challenger. After several seasons in the doldrums, the team said it was full of confidence for the new season. recently relased by the Federal Minister for Small Business, Senator Chris Schacht.
The review, conducted by solicitor Bob Gardini, recommends a strengthening of the Franchising Code of Practice so that the total number of franchisors and franchisees covered by its terms would increase and breaches of the code would attract suitable punishment. The cornerstone of the recommendations is that franchisors promoting new franchises would have to agree to the Code of Practice or else comply with Corporations Regulations, which require the issuing of a prospectus a time-consuming and expensive process. An important consideration is that if all members of the franchising industry participate in the code, it will eliminate the need for industry-specific legislation. The Institute of Chartered Accountants in Australia (ICA) has urged the Government to adopt the recommendations of the Gardini Review as a matter of urgency, saving that franchising legislation "would prove an inappropriate and blunt instrument to deal with the range of matters down. Most significant is the drop in engine size, but the cars are also aerodynamically changed so that down force is less.
